48's kickback rules
Participation in the 48 Kickback Scheme
Promotion 48 with the distribution of their SIM cards

These terms and conditions apply to the scheme whereby 48 customers (the “recruiter”) are awarded credit (“Kickback credit”) for recruiting new members to the 48 service (the “48 Kickback Scheme”).

The 48 Kickback Scheme is only for personal and consumer use. Credit cannot be transferred, sold or in any way traded.

The 48 Kickback Scheme is only available to active 48 customers and you must be opted in to the 48 Kickback Scheme in order to accumulate Kickback credit. Registration for the Kickback Scheme is through 48months.ie.

At 48months.ie customers who have registered for the 48 Kickback scheme are presented with alternative methods to promote SIM cards. For every SIM activated in accordance with these terms and conditions as a result of this promotion the recruiter will earn, either:
- €5 kickback credit once that SIM has purchased their first €10 or €15 membership, or
- €10 kickback credit once that SIM has purchased their first €20 membership.

You must only use one or more of the following methods to distribute or promote Kickback SIMs:
- ordering up to 3 Kickback SIMs at a time to be delivered to your home, so you can physically distribute them;
- promoting your own SIM order page through social media or your own website or a site that you control or.
- email directly to a known address (you need to make sure you have authorisation to send emails directly to others addresses).

48 will be able to track all new members linked to your personal SIM order page and all kickback credits will be determined by 48 and communicated to you on your Kickback home page. Your Kickback credit will be added to your existing credit balance and should be applied immediately but in some cases it may take up to 48 hours for Kickback credit to apply.

All new members who sign up via the Kickback scheme will get €5 credit once they purchase their first membership. The €5 credit will only be applied on dates stipulated by 48 and details of the dates can be found on www.48months.ie/kickback.

Kickback credit shall only be applied if the following rules are complied with:
- The recipient must be new to our network and intend to be a regular user of the service on an ongoing basis (we reserve the right to remove points where multiple SIMs have been used in the same device in order to get credit, or where the recipient hasn't used or continued to buy membership.);
- The individual activating the new account must register their details, including his/her valid email address, correct first and last name on www.48months.ie
- The individual activating the new account must activate their SIM card by purchasing an active membership

A maximum of 50 SIMs per month can be ordered through your personal SIM order page.

Kickback credit can be used to purchase 48 services. When paying for these services, Kickback credit will be decremented first followed by paid for credit. Kickback credit cannot be redeemed as cash.

The 48 Kickback Scheme is not available with any other offer and/or promotion unless otherwise specified or redeemable as a cash or credit.
- The customer must remain active to receive all earned kickback credit.

If a customer ports their number out from the 48 network their Kickback credit balance will be cleared down immediately.

As per the disconnection terms and conditions if a customer has not had a balance decrementing in event in 6 months their Kickback credit balance is cleared down and will not be reinstated should a customer subsequently reactivate their SIM.

48 can take any action it considers appropriate if we have reason to believe that you are abusing the 48 Kickback Scheme, including withholding kickback credit previously credited to your account.

You are responsible for providing 48 with accurate information. 48 shall not be held responsible for any incorrect information that you provide to us or any delays or other circumstances you experience which may affect your ability to receive a kickback.

We can suspend/remove customers should they provide false or misleading information.

48 provides a number of methods as a way to promote 48 but could refuse rewarding a member if he is using inappropriate methods of promotion. Inappropriate 48 promotion could include:
- Infringing trademark rights of 48 or any third party or otherwise violating the rights of any third party. You may use certain promotional content that 48 provides to you. You agree to forward any claims or complaints you may receive in connection with the promotional content to 48 immediately, and you also agree to remove it immediately upon 48's request.
- Bidding on 48 related terms. You may not bid on search terms or keywords used by any internet search engine or other directory or referral service (e.g. Google, Yahoo, Bing etc.) to return or prompt internet search results, if keyword is, includes, or is confusingly similar to any 48 trademark.
- Sites that include a 48 trademark in the domain name. You may include 48 as part of a subdirectory (i.e. example.com/48), or a subdomain (i.e. 48.example.com) but not in the main URL structure (i.e. join48.com) Members are not permitted to use '48' or '48months' or any variation thereof in the primary domain of urls including those under their ownership and/or management e.g. http://www.48-sim-cards.ie/. It is however permissible to use the '48' brand within a subset of the primary domain i.e. www.yourdomain.ie/48.
- Impersonating 48. You may not promote 48 in a way that you include, without limitation, graphical images, logos, text copy, editorial copy, press releases or marks, that (i) could be interpreted to suggest that such content has been authored or otherwise provided by, or represents the views or opinions of, 48; (ii) is misleading, defamatory, libellous, obscene, or otherwise objectionable; (iii) infringes, derogates, dilutes, or impairs the rights of 48 or any third party; (iv) refers to 48 but is used as part of a name of a product or service of a company other than 48; or (v) is used in any other manner inconsistent with these terms and conditions or with any provision of law. We may at our discretion ask you to modify your promotional material or clearly state that your site is not official and to include links to 48months.ie.
- Contain sexually explicit materials or hate/violent/offensive content
- Promote illegal activities or otherwise violate any applicable laws (this includes SPAM). If you want to send out any emails that advertise or promote 48, you will need 48's approval. Emails or other communications must comply with the Data Protection Act and any other relevant laws, in particular, the Privacy and Electronic Communications Regulations 2011.
- Do not clearly state an online privacy policy to their visitors.
- Use fraudulent means to prompt clicks.
- Otherwise are considered inappropriate in 48's view.

48 will keep its right, title and interest in its names, logos, trademarks, service marks and copyrights, including those that it may use or develop in the future. Any goodwill resulting from your use of 48's name, logos, trademarks, service marks and copyright will not create any right, title or interest for you as a Kickback Affiliate.

You will maintain the quality of your services at a level satisfactory to 48. 48 shall attimes have the right to review your activities. You are responsible for notifying 48 of any problems with your participation in the Promotion.

You confirm that: (a) the promotion of 48 does not (i) infringe on 48's or any third party's copyright, patent, trademark, trade secret or other proprietary rights or right of publicity or privacy; (ii) violate any applicable laws or regulations; (iii) contain defamatory or libellous material; (iv) contain lewd, pornographic or obscene material; (vii) contain viruses, Trojan horses, or other similar harmful programmes; (viii) involve content locking or domain squatting; and (b) you have and comply with a privacy policy that is prominently displayed on your Site.

48 shall not be liable for any direct, special, indirect, incidental or consequential damages (including, but not limited to loss of use, data, profits or business interruption) arising in any way out of this agreement, however caused and whether under contract, tort (including negligence), strict liability, or otherwise, even if 48 has been advised of the possibility of such damage.

You agree to indemnify, defend and hold harmless 48 and its affiliates, directors, officers, employees and agents, from and against any and all liability, claims, losses, damages, injuries or expenses (including reasonable legal fees) brought by a third party, arising out of a breach, or alleged breach, of any of your representations or obligations.You agree to indemnify, defend and hold harmless 48 and its affiliates, directors, officers, employees and agents, from and against any and all liability, claims, losses, damages, injuries or expenses (including reasonable legal fees) brought by a third party, arising out of a breach, or alleged breach, of any of your representations or obligations.

24. Either 48 or you may terminate this agreement at any time, for any reason. 48 can terminate this agreement immediately if you breach any of these terms or conditions. You will have to immediately stop using 48's name, logos, trademarks, service marks, creative work, when this agreement ends.

48 reserve the right to modify these terms and conditions or discontinue this 48 Kickback Scheme (or any part of it) for valid commercial, technical or operational reasons, without prior notice being issued to the Customer. Members may be removed from the scheme at any time at the discretion of 48.

If the 48 Kickback Scheme is withdrawn, any kickback must be used within 2 months from the date of withdrawal or such other timeframe as 48 may in its sole discretion determine. Any credit not used during this period will expire.

Persons registering for the 48 Kickback Scheme will be deemed to have accepted these terms and conditions.
